Mediation is a confidential process in which the parties and their attorneys meet with a neutral third-party who helps facilitate a discussion and resolution of the parties’ issues. Unlike in arbitration, a mediator does not make a binding decision for the parties. Instead, the mediator helps the parties reach an agreement that resolves their issues. While litigation before a judge can seem cold, mediation helps parties feel that their needs and concerns have been heard during the highly emotional process of separating from a spouse or deciding child custody.
